Rock County – Attempted Homicide Charge Dismissed on the Morning of Trial

Attorney Saperstein’s client was charged with a shooting that took place in a parking lot outside of a tavern in Beloit. Through disciplined, aggressive and thorough investigation, as well as pretrial litigation and trial preparation, Attorney Saperstein was able to show that the lead detective for the State had lost or destroyed some key exculpatory evidence. The case was dismissed just minutes before jury selection on the morning of trial.

Dane County – Jury Acquittal on OWI & PAC Charges

Saperstein’s client was pulled over for speeding 20 mph over the posted limit near his home in Verona. After performing field sobriety tests he was arrested. His blood was taken approximately 1 1/2 hours later, registering a .096 blood alcohol concentration. Through cross examination of the County’s witnesses, including the arresting officer and the blood analyst, Attorney Saperstein was able to successfully argue that his client was not impaired, and had a blood alcohol concentration below .08 at the time of driving. The jury acquitted.

Walworth County – OWI Jury Trial Win

Attorney Saperstein’s client was stopped by police while sitting in his parked, running vehicle outside of a house where a party he had attended was broken up for loud noise. He refused to take a breath or blood test. A jury acquitted the client of OWI 1st after Attorney Saperstein argued that the State had not proven that the parking lot where his car was located was “held out for public use.”

Dane County – Disorderly Conduct Reopened and Reduced (“Expungement”)

Client was applying for government and NGO work that would require him to travel internationally; and an old misdemeanor disorderly conduct conviction was preventing him from passing background checks and from traveling to certain countries. Although client was not eligible for formal “expungement,” Saperstein negotiated an agreement with the prosecutor to reopen the criminal charge and reduce it to a ticket. Client’s future got a whole lot brighter.
