City of Middleton – OWI by Controlled Substance Reduced to Inattentive Driving

Attorney Saperstein’s client was pulled over for alleged weaving outside of her lane. Officer did not note any odor of alcohol, but required client to perform field sobriety tests and her blood was drawn. Attorney Saperstein was able to get the OWI reduced to an inattentive driving citation by arguing that her satisfactory performance on the field sobriety tests did not provide probable cause for the arrest and blood draw.
